May I insist on using my own conveyancer as the purchaser?

Yes! And you should. Even though the norm in South Africa is for the seller to select the conveyancer, there is no law that states you cannot insist on using your own conveyancer. Remember, you are paying for the conveyancer, and by using your own conveyancer, you can get better pricing and service.

What does the conveyancing process look like for transferring a property to my entity?

There are eight basic steps to this process:

  1. Receive instruction
  2. Bond approved or purchase price paid (cash)
  3. FICA, requested documents and info received by transfer and bond attorneys
  4. Signing of documents and payment of costs
  5. Transferring attorneys receive clearance and levy figures and payment of costs
  6. Transferring attorneys receive the clearance certificate, and the bond attorneys proceed to lodge
  7. Deeds office process
  8. Delivery of registered deeds

Who are the parties to a property transaction when a property is purchased?

The Seller, the Purchaser, the Estate Agent, the Bond Cancellation Attorney, the Bond Registration Attorney, the Transfer Attorney, and the Bond Originator.
